1. About this warranty
DARIA is a registered trademark of Multi Ways International L.L.C. (“MWI”), a company registered and incorporated in the Emirate of Dubai, United Arab Emirates.
MWI provides this limited manufacturer’s warranty for eligible smartphones in the DARIA bond series, including bond II, bond II Lite, and other bond smartphone models sold in the United Arab Emirates (each a “Covered Product”).
This warranty also applies to eligible genuine DARIA accessories packaged with a Covered Product or sold or supplied as a promotional gift by MWI or an authorized DARIA seller in the UAE (each an “Eligible Accessory”).
This warranty is additional to, and does not exclude, restrict, or replace, any rights or remedies available to consumers under applicable UAE law.
2. Warranty coverage and period
Subject to the terms and exclusions below, MWI warrants that a Covered Product or Eligible Accessory will be free from defects in materials and workmanship under normal use for the following periods:
- DARIA bond smartphone: 12 months
- Built-in rechargeable battery: 12 months against manufacturing defects
- Original charging cable and other genuine DARIA accessories packaged in the smartphone box: 6 months
- Genuine DARIA charger or other accessory sold separately or supplied as a promotional gift: 6 months
The warranty period begins on the date the consumer receives the Covered Product or Eligible Accessory. A separately sold or gifted charger has its own accessory warranty period; it does not extend or alter the warranty period of the Covered Product.
The sales invoice, receipt, delivery record, or reliable records maintained by MWI or an authorized DARIA seller may be used to establish the delivery date. If the delivery date cannot reasonably be established, MWI may use other reliable purchase or activation records, subject to applicable law.
Where required by UAE law, the warranty period will be extended for any period during which the consumer cannot use the Covered Product because of a covered repair or a delay attributable to MWI, including a delay in providing required spare parts.
A replacement Covered Product supplied because of a covered defect will receive the warranty protection required by applicable UAE law beginning from the date the consumer receives the replacement.
3. Eligible products
This warranty applies only to:
- New and genuine smartphones in the DARIA bond series sold in the UAE by MWI or an authorized DARIA seller;
- Products intended by MWI for sale and use in the UAE;
- Products bearing an identifiable and unaltered model number and IMEI or serial number; and
- Products for which the purchase and delivery details can be verified through acceptable proof of purchase or reliable MWI or authorized-seller records.
Products purchased outside the UAE, imported independently, or not intended for the UAE market are not covered by this UAE limited warranty. MWI may offer inspection or paid repair for such products where technically possible and where suitable parts are available.
4. Transfer of warranty
The remaining warranty may be transferred with the Covered Product to a subsequent owner.
A subsequent owner must provide acceptable proof of the original purchase or permit MWI to verify the purchase through reliable records. The model and IMEI or serial number must correspond with those records.
Transfer does not restart or extend the original warranty period.
5. What the warranty covers
This warranty covers a defect in a Covered Product or Eligible Accessory that:
- Results from defective materials, design, assembly, or workmanship;
- Occurs during the applicable warranty period;
- Arises while the Covered Product or Eligible Accessory is being used normally and in accordance with DARIA’s user manual and safety instructions; and
- Is not caused by an excluded circumstance described in this policy.
Coverage includes the labor and parts reasonably required to diagnose and remedy a confirmed covered defect.
Normal reduction in rechargeable-battery capacity through ordinary use and aging is not considered a manufacturing defect. A battery may nevertheless be covered where an authorized technical assessment confirms that it is defective rather than normally degraded.
6. Warranty remedies
After inspecting the product, MWI or a DARIA-authorized service provider will determine whether the reported condition is covered by this warranty.
For a confirmed covered defect, MWI will provide an appropriate remedy without charging the consumer for covered parts or labor. Depending on the circumstances and applicable law, MWI may:
- Repair the defective Covered Product or Eligible Accessory;
- Replace a defective component;
- Replace the product with a new or functionally equivalent product that complies with applicable legal requirements; or
- Refund the purchase price where repair or replacement is unavailable, unsuccessful, inappropriate, or otherwise required by applicable law.
MWI will generally attempt a repair before replacing the Covered Product, unless replacement or refund is required under applicable law or is the more appropriate remedy.
MWI will provide the consumer with a written repair estimate or service order describing the reported condition and the expected repair period. Consumer approval will be obtained before any chargeable work is performed.
If a covered repair is expected to take more than seven days, MWI will provide an appropriate temporary replacement or agree with the consumer on another legally compliant compensation mechanism, as required by applicable UAE law.
If MWI cannot successfully repair a recurring covered defect after the repair attempts permitted by UAE law, the consumer will be entitled to the applicable replacement or refund remedy. Nothing in this policy limits rights arising from repeated defects or extended unsuccessful repairs.
Repairs and replaced parts will receive at least the service warranty required by UAE law or the remainder of the original applicable warranty, whichever provides the consumer with greater protection.
7. What is not covered
This warranty does not cover a defect, failure, or damage caused by or resulting from:
- Normal wear and tear, aging, discoloration, scratches, dents, or other cosmetic deterioration that does not affect normal operation;
- Gradual reduction of rechargeable-battery capacity through ordinary use;
- Accidental damage, including drops, impact, crushing, bending, cracked glass, or damage caused by excessive pressure;
- Exposure to liquids, moisture, condensation, sand, dust, chemicals, extreme temperatures, fire, or improper ventilation;
- Improper use, abuse, neglect, or failure to follow the user manual, safety information, charging instructions, or maintenance guidance;
- Use of incompatible, counterfeit, damaged, or unapproved chargers, cables, batteries, accessories, power sources, or peripherals;
- Electrical surges, abnormal voltage, lightning, fire, flood, natural disaster, civil disturbance, or another event outside MWI’s reasonable control;
- Improper installation, modification, disassembly, or attempted repair;
- Repairs or modifications performed by an unauthorized person where the claimed defect or damage was caused or materially contributed to by that work;
- Unauthorized modification of the operating system, bootloader, firmware, security controls, or device identifiers where that modification caused or materially contributed to the claimed defect;
- Malicious software, viruses, incorrectly installed third-party software, incompatible applications, or failure to install reasonably necessary security or system updates;
- Network, SIM-card, mobile-operator, third-party application, or third-party service problems that are not caused by a defect in the Covered Product;
- Loss, theft, or loss of use unrelated to a covered defect;
- Removal, alteration, falsification, or illegibility of the model number, IMEI, serial number, security label, or other identifying information; or
- A defect that was clearly disclosed and accepted when the product was sold as used, refurbished, or otherwise not new.
An advertised ingress-protection or water-resistance rating describes performance under specified laboratory conditions. It is not a guarantee against liquid damage. Resistance may diminish through normal wear, impact, unauthorized repair, or deterioration of seals.
An exclusion will be applied only to the extent permitted by applicable law and where the excluded circumstance caused or materially contributed to the claimed defect or damage.
8. Software and data
This hardware warranty does not create a separate warranty for software, applications, online services, mobile networks, or third-party content. Applicable software may be governed by its own licence terms.
Before submitting a Covered Product for inspection or repair, the consumer should:
- Back up personal files and other important data;
- Remove the SIM card and any removable storage;
- Remove cases and accessories not requested by DARIA Support;
- Disable device-locking or device-location features when instructed and safe to do so; and
- Erase confidential data where reasonably possible.
Inspection, repair, software restoration, or replacement may require the Covered Product to be reset or its storage to be erased. MWI is not responsible for data loss to the maximum extent permitted by law, except where loss results from MWI’s breach of an applicable legal obligation.
Consumers remain responsible for maintaining appropriate backups. MWI personnel should not be provided with account passwords except through an authorized and secure service process where strictly necessary.
9. Making a warranty claim
To request warranty service, contact DARIA Support before sending or delivering the Covered Product or Eligible Accessory.
The consumer should be prepared to provide:
- Their name and contact details;
- The bond smartphone or accessory model;
- The IMEI or serial number;
- The date and place of purchase;
- An invoice, receipt, delivery confirmation, or other acceptable proof of purchase;
- A clear description of the reported defect; and
- Photographs, video, diagnostic information, or other reasonable information requested to assess the claim.
DARIA Support will provide a claim or service reference and instructions for inspection, delivery, collection, or attendance at an authorized service location.
Warranty repair will begin after the Covered Product or Eligible Accessory has been received and assessed by MWI or a DARIA-authorized service provider.
10. Inspection and non-warranty service
If inspection establishes a covered defect, the applicable warranty remedy will be provided without charge for covered parts and labor.
If no covered defect is found, or if the condition resulted from an exclusion in this policy, MWI may offer paid repair or replacement where service and parts are available.
Any diagnostic charge, repair price, replacement price, transport charge, or other paid service will be disclosed to the consumer for approval before chargeable work begins.
MWI may decline to carry out a repair where:
- The product cannot be repaired safely;
- Required parts are no longer reasonably available;
- The product has been materially altered;
- Repair would violate applicable law or technical requirements; or
- The consumer does not approve the disclosed cost of non-warranty work.
11. Transport
Unless DARIA Support confirms another arrangement, the consumer is ordinarily responsible for arranging and paying for transport of the Covered Product or Eligible Accessory to and from the instructed authorized service location.
MWI will bear transport, return, replacement, or recall costs whenever required by applicable UAE law, including applicable cases involving recurring covered failures, a product recall, or a safety-related defect.
The consumer should package the Covered Product or Eligible Accessory securely and follow the transport instructions supplied by DARIA Support. MWI is not responsible for loss or damage caused by inadequate packaging or transport arranged independently by the consumer, except to the extent responsibility cannot lawfully be excluded.
12. Product safety and recalls
If MWI identifies a defect that may affect the safe or effective use of a DARIA bond smartphone or Eligible Accessory, MWI will take the notification, reporting, repair, replacement, refund, or recall measures required by applicable UAE law.
Consumers must follow any safety or recall instructions published by MWI or communicated through DARIA Support.
A safety recall or statutory remedy is not limited by the commercial warranty period where applicable law provides otherwise.
13. Consumer rights and limitations
This limited warranty does not affect any statutory rights or remedies that the consumer may have against MWI, an authorized seller, or another supplier under UAE law.
Where a term of this policy is inconsistent with a mandatory provision of applicable law, the mandatory provision will apply and the affected term will be limited or interpreted only to the extent necessary to comply with that law. The remaining terms will continue to apply.
To the maximum extent permitted by applicable law, MWI is not responsible under this commercial warranty for indirect or consequential loss that does not result from MWI’s breach of a mandatory legal obligation. Nothing in this policy excludes liability or remedies that cannot lawfully be excluded or limited.
