1. Agreement and scope
These Mobile Terms and Dispute Resolution Agreement (“Mobile Terms”) are between you and Multi Ways International L.L.C. (“MWI”, “we”, “us”, or “our”), a company registered and incorporated in the Emirate of Dubai, United Arab Emirates. DARIA is a registered trademark of MWI, and bond is the name of DARIA’s smartphone series.
These Mobile Terms apply when you purchase, open, activate, or use a smartphone in the DARIA bond series (the “Product”) or use related DARIA device services. By opening the Product package or using the Product, you acknowledge that you have read and agree to these Mobile Terms, including Section 16, the Dispute Resolution Agreement.
If you do not agree, do not activate or use the Product. Contact the seller promptly to ask about any return rights available under the seller’s policy or applicable law. These Mobile Terms do not exclude or limit rights that cannot lawfully be excluded or limited.
2. Eligibility and responsibility
You must have legal capacity to enter into these Mobile Terms. If the Product is used by a minor or another person who lacks full legal capacity, a parent or legal guardian is responsible for supervising use and accepting applicable terms where legally permitted.
You are responsible for using the Product safely, lawfully, and in accordance with its user manual, safety information, software notices, and applicable laws.
3. Purchase, seller, and consumer rights
Your invoice, sales contract, retailer terms, financing terms, and applicable return policy may form a separate agreement between you and the seller. If MWI is not the seller, questions about payment, delivery, cancellation, or a discretionary return should ordinarily be directed to the seller.
MWI and authorized DARIA sellers remain responsible for their respective obligations under applicable UAE consumer-protection law. Nothing in these Mobile Terms replaces the statutory remedies available for defective or non-conforming goods.
4. Package contents and accessories
Package contents vary by Product model, market, sales channel, and promotion. The contents statement printed on the package of your particular Product identifies what is supplied with that Product.
A charger is not necessarily included in the Product package. A genuine DARIA charger or other accessory may be sold separately or supplied as a promotional gift. Any applicable accessory warranty is separate from, and does not extend, the Product warranty.
Use compatible accessories and power sources that meet the specifications and safety instructions supplied for the Product. Damage caused by incompatible, counterfeit, damaged, or unapproved accessories may not be covered by the warranty to the extent permitted by law.
5. Battery
Battery life, charge cycles, charging time, and performance vary according to use, settings, applications, network conditions, temperature, battery age, and other factors. Rechargeable batteries are consumable components and their capacity naturally decreases over time. A battery may eventually require service or replacement.
Follow the charging, storage, temperature, and safety instructions supplied with the Product. Battery warranty coverage is described in the DARIA bond Smartphone Limited Warranty Policy.
6. Cellular networks and service requirements
Depending on the model, the Product may support GSM, UMTS, LTE, and NR (Sub-6 GHz) networks. Network availability, speed, emergency-service capability, roaming, and individual features depend on the Product model, radio frequencies, location, cellular plan, SIM or eSIM, and coverage and configuration provided by your service provider.
Some Product and software features require a wireless or cellular service plan, a Google Account, a DARIA account, internet access, or acceptance of additional software or service terms. Carrier, internet, roaming, and third-party charges are your responsibility.
7. DariaOS and software
DariaOS, firmware, preloaded DARIA apps, updates, and related software are licensed rather than sold. Their use is governed by the DariaOS End User Licence Agreement.
Google Mobile Services, Google applications, open-source components, and other third-party software or services are governed by their respective providers’ terms and licences.
8. DARIA accounts and services
Some optional features require a DARIA account. You are responsible for providing accurate information, protecting account credentials, and notifying DARIA Support if you suspect unauthorized access.
DARIA Wallet, points, rewards, offers, identity verification, and other optional programs may be governed by additional terms presented within the relevant app or service. Availability, eligibility, and functionality may vary by region. These Mobile Terms do not promise any particular reward, monetary value, offer, or continuing availability.
9. Updates and service changes
MWI may provide automatic security, safety, firmware, compatibility, and critical-service updates. These updates may be installed automatically where necessary to protect the Product, users, networks, or services.
Where reasonably practicable, MWI will provide notice or a choice before material non-essential changes. Updates may add, modify, remove, or replace features. Model-specific update commitments, if any, are stated in the applicable Product materials and are not expanded by these Mobile Terms.
10. Privacy
Information about personal data processed through the Product, DariaOS, and preloaded DARIA apps and system services is provided in the Daria Smartphone, DariaOS & Preloaded Daria Apps Privacy Policy.
Google, mobile operators, and third-party applications and services process information under their own privacy notices.
11. Warranty and support
Warranty periods, eligibility, exclusions, remedies, and claim instructions are provided in the DARIA bond Smartphone Limited Warranty Policy.

12. Acceptable use and security
You must not use the Product or DARIA services to:
- Violate applicable law or the rights of another person;
- Distribute malicious code, interfere with networks or services, or gain unauthorized access;
- Circumvent security, authentication, safety, or usage controls;
- Misrepresent your identity or use an account without authorization; or
- Engage in fraud, abuse, harassment, or activity that threatens people, property, networks, or services.
MWI may take proportionate steps to protect users and services, including restricting affected online services, investigating abuse, or complying with lawful authority requests. This does not authorize MWI to disable core device functionality arbitrarily.
13. Intellectual property
DARIA, DariaOS, associated logos, interface elements, and other MWI content are owned by or licensed to MWI and protected by applicable intellectual-property laws. No trademark right or ownership interest is transferred with the Product.
Third-party names, marks, software, and content remain the property of their respective owners.
14. Third-party services
The Product can access services supplied by Google, mobile operators, application developers, payment or identity providers, and other third parties. MWI does not control those independent services and is not responsible for their content, availability, security, or practices, except to the extent responsibility cannot lawfully be excluded.
Third-party services may change, suspend, or cease and may require separate accounts, payments, permissions, and terms.
15. Disclaimers and limitation of liability
The Product and DARIA services are provided subject to the express warranty, applicable service commitments, and mandatory law. To the maximum extent permitted by law, MWI does not provide additional implied guarantees concerning uninterrupted networks, third-party services, or error-free operation.
To the maximum extent permitted by applicable law, MWI is not liable for indirect or consequential loss that was not reasonably foreseeable and does not result from MWI’s breach of a mandatory legal obligation. Nothing in these Mobile Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, mandatory consumer remedies, or another liability that cannot lawfully be excluded or limited.
16. Dispute Resolution Agreement
16.1 Informal resolution
Before starting arbitration, either party must send the other a written notice describing the dispute and requested resolution. Notices to MWI must be emailed to legal@dariamobile.com. The parties will attempt in good faith to resolve the dispute for 30 days after receipt of the notice.
16.2 Individual DIAC arbitration
Unless you validly opt out under Section 16.4, a dispute not resolved informally will be finally resolved by individual arbitration administered by the Dubai International Arbitration Centre (“DIAC”) under the DIAC Arbitration Rules in force when arbitration begins. The tribunal will consist of one arbitrator. The seat of arbitration will be Dubai, United Arab Emirates, and the language will be English.
Arbitration will be conducted individually. The arbitrator may award any individual remedy available under applicable law but may not combine claims of persons who are not parties to the arbitration, except where applicable law requires otherwise.
16.3 Preserved rights
This agreement does not prevent either party from seeking urgent interim or protective relief from a competent court. It does not prevent a consumer from contacting or submitting a complaint to an authorized consumer-protection, privacy, regulatory, or law-enforcement authority. Any mandatory court right or jurisdiction that cannot lawfully be waived remains available.
16.4 Arbitration opt-out
You may opt out of arbitration by emailing legal@dariamobile.com no later than 30 days after the later of your Product purchase date or first Product activation. Your email must include:
- Your full name and contact details;
- The Product model and IMEI or serial number;
- The purchase date and, if available, proof of purchase; and
- A clear statement that you opt out of the arbitration agreement in the DARIA bond Mobile Terms.
Opting out will not affect the remaining Mobile Terms, warranty coverage, Product operation, or access to DARIA services. A timely opt-out means disputes may be brought before the competent UAE courts, subject to mandatory jurisdiction rules. Keep a copy of the sent opt-out email for your records.
17. Governing law, changes, and contact
These Mobile Terms are governed by the laws of the United Arab Emirates, without prejudice to mandatory consumer protections or jurisdiction rules.
MWI may update these Mobile Terms for legal, security, operational, or service reasons. Material changes will be communicated through the Product, DARIA services, the website, or another appropriate channel. Changes will not retroactively reduce accrued statutory rights.
